Zoinetworks Forums user agreement
By accessing this Zoinetworks (hereinafter "we", "us", "our") forum you agree to be legally bound by the following terms. If you do not agree to be legally bound by all of the following terms then please do not access and/or use this Zoinetworks forum. These terms may change at any time and Zoinetworks will do our utmost in informing you, though it would be prudent to review this regularly yourself as your continued usage of this Zoinetworks forum after changes mean you agree to be legally bound by these terms as they are updated and/or amended.
Zoinetworks forums are powered by phpBB (hereinafter "they", "them", "their", "phpBB software", "www.phpbb.com", "phpBB Group", "phpBB Teams") which is a bulletin board solution released under the "General Public License" (hereinafter "GPL") and can be downloaded from www.phpbb.com. The phpBB software only facilitates internet based discussions, the phpBB Group are not responsible for what we allow and/or disallow as permissible content and/or conduct. You agree not to post any abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-orientated or any other material that may violate any laws be it of your country, the country where this Zoinetworks forum is hosted or International Law. Doing so may lead to you being immediately and permanently banned, with notification of your Internet Service Provider if deemed required by us. The IP address of all posts are recorded to aid in enforcing these conditions. You agree that this Zoinetworks forum have the right to remove, edit, move or close any topic at any time should we see fit. As a user you agree to any information you have entered to being stored in a database. While this information will not be disclosed to any third party without your consent, neither this Zoinetworks forum nor phpBB shall be held responsible for any hacking attempt that may lead to the data being compromised.

ZOINETWORKS FORUM USER (the "User")
INTRODUCTION
Zoinetworks Limited ("Zoinetworks") operates all Zoinetworks forums, which has the following functions:
- To provide a common messaging system for users to communicate and share information over the World Wide Web.
- To allow users to share recommendations of products and services.
The Parties now wish to enter into this agreement in order to set out the terms and conditions under which the User agrees to participate in Zoinetworks forums.
DEFINITIONS
"Browser" means a software application designed to display pages from the World Wide Web.
"Forum" means a common messaging system allowing users to set up accounts and post messages to each other.
"Intellectual Property" means patents, trade marks, service marks, trade names, registered and unregistered designs, trade or business names, copyright, ideas (including, but not limited to, rights in software), rights in confidential information and any other intellectual property rights whatsoever irrespective of whether such intellectual property rights have been registered or not which may subsist in any part of the world.
"Parties" means Zoinetworks and the User.
"Profile" means a user profile on any Zoinetworks forum.
"User" means an individual who has a profile on any Zoinetworks forum.
"Zoinetworks" means Zoinetworks Limited, UK registered company number 06173126.
"Zoinetworks forum" means any forum operated by Zoinetworks.
1. ACCESS
1.1. Users will be given either user or moderator access to their forums, no administrator access will be granted.
2. ACCEPTABLE USE
2.1. Posting illegal or copyrighted material is prohibited.
3. LINKS
3.1. Zoinetworks may aggregate links posted. Aggregation will be anonymous, user names will not be individually identified with links they have posted.
4. USER NAMES
4.1. User names must be real names of users.
5. SINGLE LOGIN
5.1. Zoinetworks reserves the right to create a single Zoinetworks login which allows users to become members of different Zoinetworks forums without creating separate accounts for each
6. FEE
6.1. Zoinetworks forums have a set up fee which can be waived at Zoinetworks discretion. If a user wishing to set up a forum is not charged the fee upon set up the fee has been waived.
7. NO WARRANTY
7.1. Zoinetworks expressly disclaims any form of liability, including but not limited to any liability arising out of the operation and/or adequacy of, products or services recommended on any Zoinetworks forum.
8. NO GUARANTEE
8.1. Zoinetworks does not guarantee that Zoinetworks forums will be continuously available at all times.
9. RIGHTS OF THIRD PARTIES
9.1. A person who is not a party to this Agreement shall not have any rights under or in connection with it by virtue of the Contracts (Rights of Third Parties) Act 1999.
10. COMMUNICATION
10.1. Communication to Zoinetworks regarding any issue link should be by email to contact@zoinetworks.com.
11. INTELLECTUAL PROPERTY
11.1. The source code for Zoinetworks forums are licensed under the terms of the GNU General Public license. This license applies to the source code only and not to the design which is the copyright of Zoinetworks.
11.2. The Parties agree that all other Intellectual Property rights subsisting in the Zoinetworks forums shall remain or be the property of Zoinetworks. On the expiry or termination of this agreement all such use will stop and the User does not acquire any rights in such Zoinetworks material as a result of use. The provisions of this clause shall survive the termination or expiry of this Agreement.
12. IMAGES
12.1. Copying the images which make up the look of Zoinetworks forums is prohibited. All images which constitute how a Zoinetworks forum looks and the order in which they are arranged on screen is the sole copyright of Zoinetworks. The provisions of this clause shall survive the termination or expiry of this Agreement.
12.2. Reference to images in this clause is confined to those images which constitute the look of Zoinetworks forums. It does not include any image which is posted on a Zoinetworks forum.
13. ENTIRE AGREEMENT
13.1. This Agreement, and the documents referred to in it, constitutes the entire agreement and understanding of the Parties and supersedes any previous agreement between the parties relating to the subject matter of this agreement.
13.2. Each of the parties acknowledges and agrees that in entering into this agreement, and the documents referred to in it, it does not rely on, and shall have no remedy in respect of, any statement, representation, warranty or understanding (whether negligently or innocently made) of any person (whether party to this agreement or not).
13.3. Nothing in this clause 13 shall, however, operate to limit or exclude any liability for fraud.
14. TERM AND TERMINATION
14.1. The User agrees to participate in Zoinetworks forums for such period as they maintain a user profile.
14.2. This Agreement will terminate when the User leaves all Zoinetworks forums of which they are a member.
14.3. The provisions of this clause shall survive the termination or expiry of this Agreement.
15. GOVERNING LAW AND JURISDICTION
15.1. This Agreement shall be governed by and construed in accordance with English law.
15.2. Each party irrevocably agrees to submit to the exclusive jurisdiction of the courts of England and Wales in relation to any claim or matter arising under or in connection with this Agreement.
